Program-unique Terms
Amendment to the V5R3 and Later License Information Document for 5722-SS1
The following terms apply to Your purchase of a System i Capacity Back-up ("CBU") Machine running V5R3 or later i5/OS (5722-SS1). The following terms amend the "Transfer of Program Rights and Obligations" terms section in the corresponding i5/OS (5722-SS1) License Information document.
Your purchase of a CBU Machine requires You to identify the Primary Machine that will be paired with the corresponding CBU Machine. A "Primary Machine" is defined as the System i Machine on which the production applications normally run. The corresponding CBU Machine is the backup machine that is paired with the Primary Machine. Both the Primary Machine and corresponding CBU Machine must be in a configuration within Your Enterprise where the CBU Machine can assume some or all production from the Primary Machine. You specify the paired machines by entering serial number information regarding both the Primary Machine and the corresponding CBU Machine into the IBM CBU web site (www.ibm.com/systems/power/hardware/cbu).
Except for CBU machines which have i5/OS priced per user, the Primary Machine must be equal to or larger in size than the corresponding CBU Machine as measured by CPW (Commercial Processing Workload). A CBU Machine must continuously be paired with a Primary Machine
Base i5/OS User entitlements, i5/OS Base processor entitlements or base enterprise enablement, included at no additional charge with Your purchase of a Machine, may not be moved to the another Machine. Optional i5/OS User entitlement, optional i5/OS processor entitlements or optional enterprise enablement, purchased for an additional charge, may be temporarily moved from a Primary Machine to its corresponding CBU Machine (at which time the "Out of Compliance" i5/OS error message may be ignored) and may subsequently be moved back to the Primary Machine. Optional i5/OS User entitlement, optional i5/OS processor entitlements i5/OS or optional enterprise enablement initially acquired on the corresponding CBU Machine may not be moved to another Machine.
If Your Primary Machine is an iSeries model 825, 870, or 890, You may temporarily move 5250 OLTP to its corresponding CBU Machine and may subsequently be moved back to the Primary Machine. This movement must be in whole processors of 5250 OLTP and can only occur if there is a corresponding reduction in 5250 OLTP on the Primary Machine. The maximum number of processors of 5250 OLTP which can move from a Primary Machine to its corresponding CBU Machine is the number of optional processor entitlements to i5/OS originally licensed on the Primary Machine.
Any move of an optional i5/OS User entitlement, optional i5/OS processor entitlement, optional enterprise enablement, or 5250 OLTP from a Primary Machine to a corresponding CBU Machine terminates Your authorization to use that entitlement on the Primary Machine while it is being used on the CBU machine.
If the Primary Machine or the corresponding CBU Machine are sold or discontinued from use, then any optional entitlements must be moved back to the Machine on which they were originally licensed. If the corresponding CBU Machine is transferred, You must provide a printed copy of this license agreement in its entirety to the new owner of the machine.
IBM may audit Your compliance with these terms upon reasonable advance notice to You.
