LICENSE INFORMATION

The Programs listed below are licensed under the following terms and conditions in addition to those of the International Program License Agreement.

Supporting Programs

The Program is licensed as a multi-product package and includes other products distributed with the Program ("Supporting Programs"). Licensee is authorized to install and use such Supporting Programs only in association with Licensee's licensed use of the Program under this Agreement. The Supporting Programs may not be used for any other purpose. Licensee is not authorized to transfer or remarket the Supporting Programs. The terms of the Program's Agreement may replace or modify the license terms for the Supporting Programs. In the event of conflict, the Program's terms supersede the terms of the license agreement which accompanies the Supporting Programs. When Licensee's right to use the Program expires or terminates, Licensee must discontinue use, destroy or promptly return all copies of the Supporting Programs to the party from whom Licensee acquired it; if Licensee downloaded the Supporting Programs contact the party from whom Licensee acquired it. If Licensee wishes to license the Supporting Programs for any use beyond the limits set forth above, please contact an IBM Sales Representative or the party from whom Licensee acquired it to obtain the appropriate licenses.

The definition of Supporting Programs replaces any previous references to Other IBM Programs.

The following are Supporting Programs licensed with the Programs:

Program-unique Terms

I. The following terms and conditions within this section universally apply to the following Programs: IBM InfoSphere Federation Server V9.7 and IBM InfoSphere Federation Server Developer Edition V9.7, except where stated otherwise.

I.A Charge Metric: In these license terms, "Program" refers to the product whose license Licensee has purchased. The Program may be licensed for production use under the Processor Value Unit charge metric or may be licensed for more limited use, as specified for the Developer Edition Programs in this LI, under the Authorized User charge metric. Consult Licensee's PoE to determine which usage terms apply to Licensee's acquired Program.

I.A.1) Processor Value Units

I.A.1.a) If Licensee has acquired this Program with Processor Value Unit pricing, then the Program is licensed using Processor Value Units. The Processor Value Unit licensing model is described at URL: http://www.ibm.com/software/sw-lotus/services/cwepassport.nsf/wdocs/pvu_table_for_customers

I.A.2) Authorized User

I.A.2.a) If Licensee has acquired a license to InfoSphere Federation Server Developer Edition, Licensee must acquire a separate user license entitlement for each Authorized User of the Program as described below.

I.A.2.b) Authorized User: An Authorized User is one and only one individual with a specific identity within or outside Licensee's enterprise who has a purchased license entitlement to access the Program. A Proof of Entitlement (PoE) is required for each Authorized User accessing the Program or any Program component either directly or indirectly through any means. An example of "indirect" access would be through a multiplexing program, device, or application server.

I.A.2.c) The Program can be accessed by multiple Authorized Users provided that an Authorized User license entitlement has been obtained for each individual. An Authorized Users ID is unique to the uniquely identified individual and cannot be shared with or used by others or transferred. A single Authorized User ID, however, is entitled to establish one or more connections to the Program, each for use solely by the identified Authorized User, and only the single Authorized User entitlement is required

I.A.2.d) Access made to this Program via an Intranet (i.e., access connections from within Licensee's Enterprise) or via the Internet (i.e., access connections from outside Licensee's Enterprise) may only be made by Authorized Users.

I.B) High Availability/Failover Configurations: The terms in this section apply only to InfoSphere Federation Server. Licensee must be licensed to Licensee's production use Program(s) under the Processor Value Unit charge metric. High Availability/Failover Configurations are not offered for InfoSphere Federation Server Developer Edition.

In High Availability configurations Licensee must fully license the Program for the Primary server that is used to service user workloads; additional servers acting as backups are called Standby servers that may be deployed in Hot, Idle, or Cold configurations.

In Hot, Idle, or Cold Standby configurations, Licensee must acquire a correct number of Processor Value Unit PoE(s) in addition to the Processor Value Unit PoE(s) Licensee obtained for the Primary server.

I.B.1) Hot Standby Configuration: In a Hot Standby configuration, the Program is operational on all servers to service user transactions or queries. Because each of the Hot Standby servers is used to operate the Program for user transactions or queries before or after a failure, the Program must be fully licensed on all Hot Standby servers. When in Hot Standby, Licensee must license the Program for the number of processor cores attached or available to the each Hot Standby server. For example, consider an environment with two Servers, one Primary Server with four hundred (400) Processor Value Units (PVU) and one Hot Standby Server with two hundred (200) PVUs. This environment must be licensed for six hundred (600) PVUs, four hundred (400) PVUs for the Primary Server and two hundred (200) PVUs for the Hot Standby Server.

I.B.2) Idle Standby Configuration: In an idle standby configuration, Idle Standby servers have the Program installed, however, they do not have the Program operational to service user transactions or query workloads. A server is considered "idle" if it is used exclusively for administrative actions that assist in failover scenarios such as having a database in rollforward pending state to support log shipping. In Idle Standby, Licensee must license the Program for 100 Processor Value Units per Idle Standby server only, irrespective of the number of processor cores attached or available to the server. Licensee is entitled to install IBM DB2 Restricted Enterprise Edition and IBM WebSphere MQ on the same Idle Standby server as the Program.

When in Idle Standby, Licensee must license the Program for one hundred (100) PVUs per Idle Standby Server only, regardless of the number of processor cores attached or available to the Server. For example, consider an environment with two Servers, one Primary Server with four hundred (400) Processor Value Units (PVU) and one Idle Standby Server with two hundred (200) PVUs. This environment must be licensed for five hundred (500) PVUs (four hundred (400) PVUs for the Primary Server and one hundred (100) PVUs for the Idle Standby Server).

I.B.3 Cold Standby Configuration:

In a Cold Standby configuration, Cold Standby servers may have the Program installed, however, they do not have the Program started or operational. The Program is installed for backup purposes only on the Cold Standby Server(s).


When in Cold Standby, there is no charge for the Cold Standby Server(s). For example, consider an environment with two Servers, one Primary Server with four hundred (400) Processor Value Units (PVU) and one Cold Standby Server with two hundred (200) PVUs. This environment must be licensed for four hundred (400) PVUs for the Primary Server, no PVUs are required on the Cold Standby Server.

I.C) Licensee is authorized to make copies of documentation in support of Licensee's authorized use of the Program.

I.D) InfoSphere Federation Server usage restrictions

I.D.1) If Licensee has acquired a license to the InfoSphere Federation Server Developer Edition Program, then the Program can be installed on one or more shared servers for use by all Authorized Users with valid InfoSphere Federation Server Developer Edition license entitlements, up to the level of use authorized by the PoE. Licensee may use all components of the Program only for the purposes of evaluating, demonstrating, testing, and developing application programs. Licensee may not use the Program for any other purposes, including, but not limited to, production or support of normal business operations.

I.D.2) Limited use license of DB2 Restricted Enterprise Edition:

I.D.2.a) DB2 Restricted Enterprise Edition includes portions of DB2 Enterprise Server Edition. Licensee is authorized to install and use one copy of DB2 Restricted Enterprise Edition only in association with Licensee's licensed use of the Program and solely for the storage and management of data used or generated by the Program, and not for other data management purposes. Examples of data used or generated by the Program includes, but is not limited to, Materialized Query Tables (MQTs), stored procedures and tables used in federated queries and are stored locally. DB2 Restricted Enterprise Edition can be used as a repository for data generated by the Program and can be used as a repository for application data that is part of a federated system. A federated system allows Licensee to query and manipulate data located on distributed data servers as though the data were located in a single data server. Licensee is not authorized to install or use any separately purchasable features that are available for DB2 Enterprise Server Edition unless Licensee purchases a fully licensed version of DB2 Enterprise Server Edition from IBM or Licensee's DB2 Reseller. Examples of separately purchasable features include the Performance Optimization Feature for ESE, and the Storage Optimization Feature.

I.D.3) Limited use license of WebSphere MQ:

I.D.3.a) For each server on which the Program is installed, Licensee is entitled to install, from the media provided with the Program, the WebSphere MQ runtime components provided to support Licensee's licensed use of the Program. Licensee's use of WebSphere MQ is limited to use only in support of Licensee's licensed use of the Program, and is also subject to the terms and conditions of the license agreement which accompanies WebSphere MQ, except as limited in this license. The WebSphere MQ program may not be used for any other purpose unless a full license for WebSphere MQ is purchased from IBM or Licensee's Reseller.

I.D.3.b) When used with InfoSphere Federation Server, Licensee is entitled to use WebSphere MQ only for the following:

- To enable communication across multiple servers on which InfoSphere Federation Server is installed

I.D.4) Limited use license of InfoSphere Replication Server components:

I.D.4.a) InfoSphere Federation Server includes data replication components of InfoSphere Replication Server. Licensee is authorized to install and use these data replication components on the same system as InfoSphere Federation Server only in support of Licensee's licensed use of InfoSphere Federation Server. Specifically, you are entitled to use these data replication components only to refresh 'cache tables'. A "cache table" is a capability provided by the Program to improve query performance by storing the data locally instead of accessing the data directly from the data source. Use of the data replication components for any other purpose requires that Licensee purchases a fully licensed version of InfoSphere Replication Server from IBM or Licensee's IBM Reseller.
